Rental Terms & Conditions

These Terms and Conditions form an integral and binding part of the Motorcycle Rental Agreement. By signing this Agreement, the Lessee confirms that they have read, understood, and freely accept all terms set out below.

1. Definitions

For the purposes of this Agreement:

  • "Lessor" or "Outlandica" means OUTLANDICA SRL, operating under the trade name Outlandica, with its registered address in Cluj Napoca, Romania.
  • "Lessee", "Customer", or "Rider" means the individual identified in the Rental Agreement (Part A) who rents the Motorcycle from Outlandica.
  • "Motorcycle" or "Vehicle" means the motorcycle described in Section A2 of the Rental Agreement, together with all keys, documents, and accessories listed in Section A4.
  • "Rental Period" means the period beginning at the confirmed pickup time and ending at the agreed return time, as specified in Section A3 of the Rental Agreement.
  • "Security Deposit" means the refundable amount collected at pickup as a guarantee against damage, loss, and any other Lessee obligations under this Agreement.
  • "Damage Deductible" means the maximum amount the Lessee is liable for in respect of accidental damage to the Motorcycle, equivalent to the Security Deposit amount, unless full liability applies as set out in Sections 10 and 11.
  • "Off-Road Riding" means use of the Motorcycle on terrain that is not a paved public road, including gravel tracks, trails, and unsealed mountain paths.
  • "Force Majeure" means any event beyond the reasonable control of either party, including natural disasters, war, governmental restrictions, or pandemic declarations.

2. Eligibility and Licensing Requirements

To rent a motorcycle from Outlandica, the Lessee must fulfil all of the following requirements at the time of pickup:

  • Age: the Lessee must be at least 21 years of age.
  • Driving Licence: the Lessee must hold a full, valid Category A or Category A2 motorcycle licence appropriate for the rented motorcycle. The Lessee must have held a Category A or Category A2 licence — whichever category applies to the rented motorcycle — for a minimum of 2 (two) years. EU/EEA licences are accepted. Riders with a licence issued by a non-EU/EEA authority whose drivers licenses are not directly recognised by Romanian authorities must present the valid additional documents required by Romanian law like an International Driving Permit (IDP) alongside their national licence.
  • Identity Document: a valid passport or, for EU/EEA nationals, a national identity card must be presented in original at pickup. Copies are not accepted.
  • Physical Fitness: the Lessee must be in adequate physical condition to ride safely and must not be under the influence of alcohol, drugs, or any medication that impairs riding ability.

Outlandica reserves the right to refuse the rental if, in its reasonable judgment, the Lessee does not meet the above requirements or appears unfit to ride safely. In such cases, the cancellation policy in Section 4 applies to any amounts already paid.

3. Booking and Payment

3.1 Reservations may be made via the Outlandica website, by email, or by phone. A booking is confirmed only upon Outlandica's written confirmation and receipt of any applicable advance payment.

3.2 Outlandica requires an advance payment of 50% of the total rental fee for reserving the motorcycle. The balance is due in full at the time of pickup.

3.3 All prices are quoted in Euro (EUR). Payment may be made in EUR directly, by credit or debit card (Visa, Mastercard) or by bank transfer. Payment in Romanian Lei (RON) is accepted at the official conversion rate stated by Banca Transilvania on the day the payment is charged. Maestro cards are not accepted.

3.4 Outlandica will issue an advance payment request upon receiving the booking inquiry and defining the rental details. If an advance payment is not received within 3 (three) business days of the payment request being sent, Outlandica reserves the right to cancel the reservation without prior notice.

3.5 All prices include Romanian VAT (TVA) where applicable. Prices do not include fuel, road tolls, parking charges, fines, or any personal expenses.

3.6 In case a booked motorcycle becomes unavailable, Outlandica will try to replace it with a vehicle from a similar class or higher at no additional cost. If no such replacement is available, Outlandica will refund the already paid rental fee.

4. Cancellation and Rescheduling

4.1 Cancellations must be submitted in writing (email or messaging application with a written record) to Outlandica. The effective date of cancellation is the date Outlandica receives written notice.

4.2 The following cancellation fees apply:

  • More than 30 days before the Rental Period: full refund of amounts paid, minus bank transfer or processing fees.
  • 14 to 30 days before the Rental Period: 50% of the total rental fee refunded; 50% retained by Outlandica.
  • 7 to 14 days before the Rental Period: 25% of the total rental fee refunded; 75% retained by Outlandica.
  • Fewer than 7 days before the Rental Period, or no-show: no refund.

4.3 Rescheduling is permitted once, free of charge, if requested at least 14 days before the original start date and subject to motorcycle availability. The new rental dates must fall within 6 months of the original dates.

4.4 In the event of Force Majeure preventing the commencement or continuation of the rental, Outlandica will offer either a full credit note valid for 12 months or a proportional refund for unused days if the rental has already begun.

4.5 Early termination of the rental by the Lessee does not entitle the Lessee to a refund for unused rental days.

4.6 Outlandica reserves the right to cancel a booking where it is unable to provide the reserved motorcycle due to unforeseen circumstances (mechanical failure, theft, Force Majeure). In such cases Outlandica will offer a comparable substitute or a full refund. This constitutes Outlandica's maximum liability in such circumstances.

5. Security Deposit

5.1 A Security Deposit is required for every rental. The standard amount is EUR 1,000, unless specified otherwise in the Rental Agreement.

5.2 The Security Deposit is collected at pickup. It is processed as a pre-authorisation (card hold) on a valid Visa or Mastercard credit or debit card. Maestro cards are not accepted for the deposit.

5.3 The Security Deposit serves as a guarantee against:

  • Damage to or loss of the Motorcycle and its accessories;
  • Unpaid traffic fines and associated processing fees;
  • Excess rental charges due to late return;
  • Failure to return the Motorcycle with a full fuel tank;
  • Cleaning fees for excessive soiling;
  • Loss of keys or vehicle documents;
  • Loss of rental income charged under Section 11.6;
  • Any other amounts owing to Outlandica under this Agreement.

5.4 Upon return of the Motorcycle in the same condition as received (normal wear excluded), with all accessories and documents, and with all obligations under this Agreement fulfilled, the deposit will be released or refunded in full within 10 (ten) business days.

5.5 If a chargeable event occurs, Outlandica will deduct applicable costs from the Security Deposit and refund any remaining balance within 10 (ten) business days of completing the damage assessment. If total costs exceed the deposit, the Lessee is liable for the difference.

5.6 The Lessee may not offset the Security Deposit against any outstanding rental payments.

6. Vehicle Handover and Return

6.1 At pickup, both parties will jointly inspect the Motorcycle and complete the Vehicle Condition Report in Section A5. Any pre-existing damage must be agreed and noted before the Lessee takes possession. Damage not documented at pickup can be attributed to the Lessee on return, at the sole discretion of Outlandica.

6.2 Outlandica will deliver the Motorcycle in a technically sound, roadworthy, and clean condition, along with its registration certificate (certificat de inmatriculare), compulsory third-party insurance document (RCA), and one key.

6.3 The Lessee must check tyre pressure, engine oil level, coolant level, and chain tension regularly.

6.4 The Motorcycle must be returned at the agreed date, time, and location specified in Section A3. Extensions to the Rental Period must be requested at least 24 hours in advance, are subject to availability, and must be confirmed in writing by Outlandica.

6.5 A grace period of 30 minutes applies to the agreed return time. Returns more than 30 minutes late will incur an additional charge equal to the applicable daily rate for each commenced day of delay. Late returns that exceed 24 hours will have a 2 time multiplier added to the daily rental fee for every day exceeding the initially agreed period. The multiplier only applies if no case of mechanical failure or Force Majeure is present.

6.6 The Motorcycle must be returned with a full fuel tank. If returned with less than a full tank, a surcharge of EUR 30, plus the cost of the missing fuel at current local pump prices, will be charged.

6.7 The Motorcycle must be returned in a reasonably clean condition. If returned excessively soiled (beyond normal road dust or rain spots), a cleaning fee of EUR 40 will be charged.

6.8 All vehicle documents, keys, and rented accessories must be returned together with the Motorcycle. Loss or destruction of: (a) a key — EUR 200; (b) vehicle documents (registration certificate) — EUR 100.

6.9 If the Lessee fails to return the Motorcycle at the agreed time without prior notice or legitimate justification, Outlandica may report the Motorcycle as stolen to the Romanian Police (Politia Romana) and relevant authorities.

7. Lessee Obligations

Throughout the Rental Period, the Lessee undertakes to:

  • Use the Motorcycle with due care and attention, in accordance with the manufacturer's operating instructions and Romanian road traffic regulations.
  • Carry at all times the Motorcycle's registration certificate, RCA insurance document, their own valid driving licence and identity document, and present these to law enforcement or other authorised persons upon request.
  • Lock the Motorcycle with the handlebar lock whenever it is left unattended.
  • Stop the Motorcycle immediately if any warning light indicates an anomaly, and contact Outlandica before proceeding.
  • Comply with all applicable Romanian and international road traffic laws.
  • Pay all parking fees, road tolls, fines, and other charges incurred during the Rental Period. Outlandica may charge a processing fee of EUR 25 per penalty notice received on behalf of the Lessee.
  • Not allow any person not named in this Agreement to ride the Motorcycle under any circumstances.
  • Not transport more passengers or cargo than the Motorcycle's approved maximum load permits.
  • Not sub-rent, lend, pledge, sell, or otherwise transfer possession or use of the Motorcycle to any third party.
  • Not take the Motorcycle outside the borders of Romania. Cross-border use is strictly prohibited without Outlandica's prior written authorisation, which must be requested at least 7 days in advance. Unauthorised border crossings constitute a serious breach of this Agreement and void all insurance coverage.
  • Not make any technical modifications or alterations to the Motorcycle.
  • Not use the Motorcycle for commercial purposes (courier, delivery, etc.).

8. Restrictions on Use

The Lessee must NOT use the Motorcycle for any of the following purposes, under any circumstances:

  • Riding under the influence of alcohol (blood alcohol above the 0.00 g/L limit under Romanian law), illegal drugs, narcotics, or any medication that impairs the ability to ride safely.
  • Riding when physically fatigued, ill, or otherwise unfit to ride.
  • Participating in any motorsport competition, race, timed trial, or organised competitive event of any kind.
  • Performing stunts, wheelies, burnouts, or any riding that places abnormal or disproportionate stress on the Motorcycle's components.
  • Using the Motorcycle on dedicated motocross or enduro circuits, quarries, or any racing venue.
  • Taking the Motorcycle across any international border without Outlandica's prior written authorisation (see Section 7).
  • Carrying loads that exceed the Motorcycle's manufacturer-rated maximum payload.
  • Any illegal purpose under Romanian law or the law of any jurisdiction in which the Motorcycle is operated.

Breach of any prohibition in this Section constitutes automatic cancellation of all insurance coverage and renders the Lessee fully liable for all resulting costs without limitation to the Damage Deductible.

9. Off-Road Riding — Permitted With Conditions

9.1 Off-road riding is expressly permitted under certain strict conditions. We do not prohibit off-road use. It is, however, subject to the following conditions, which the Lessee must read carefully and accept before riding off-road.

9.2 Permitted off-road terrain:

  • Legally accessible public roads and unsealed gravel tracks.
  • Mountain roads and passes open to public motor traffic in an unsealed or partially unsealed condition.
  • Adventure terrain of moderate technical difficulty appropriate to the motorcycle's specifications and the Lessee's experience.

9.3 Terrain that is strictly prohibited:

  • Dedicated motocross tracks, enduro circuits, or any venue set up for organised competitive events.
  • Deep water crossings or any crossing clearly beyond the Motorcycle's design capability.
  • Private land or enclosed areas.
  • Protected natural areas like national parks, nature reserves, or "Natura 2000" sites, where motorised access is prohibited by applicable Romanian or EU law.

9.4 Lessee's responsibility and liability during off-road riding: The Lessee explicitly acknowledges and accepts all of the following:

  • Off-road riding inherently carries a higher risk of damage than on-road riding. The Lessee assumes full personal responsibility for all risks associated with Off-Road Riding.
  • All damage to the Motorcycle sustained during Off-Road Riding — including falls, grounding, and impacts with obstacles, is subject to the Damage Deductible provisions of Section 11. If damage results from terrain clearly beyond the Motorcycle's capabilities, from reckless or intentional misuse, or from terrain in the prohibited categories in Section 9.3, the Lessee may be held fully liable without limitation to the Damage Deductible.
  • If the Motorcycle becomes stuck, beached, stranded, or otherwise immobilised during Off-Road Riding, all recovery, towing, and extraction costs are borne exclusively by the Lessee. The Lessee must contact Outlandica immediately and must not authorise third-party recovery without Outlandica's consent. Outlandica may charge a recovery fee in case the motorcycle becomes immobilised by the fault of the lessee.
  • Damage to the Motorcycle itself is entirely the Lessee's responsibility, subject to the Damage Deductible provisions of Section 11. The Lessee accepts this risk in full.
  • Before attempting any off-road section, the Lessee warrants that they have: (i) assessed the terrain and confirmed it falls within the permitted categories above; (ii) honestly assessed their own skill level against the demands of the terrain; and (iii) ensured the Motorcycle is in suitable condition for the intended terrain.

9.5 Outlandica strongly recommends that Lessees intending significant Off-Road Riding carry a basic first-aid kit, recovery tools (tyre plugs, hand pump), a fully charged communication device, inform someone of their planned route, and ride with at least one other rider where possible.

10. Insurance Coverage

10.1 All Outlandica motorcycles carry mandatory third-party liability insurance (RCA) in accordance with Romanian law. The RCA policy covers damage caused to third parties (persons and property) in accidents for which the Lessee is at fault, up to the statutory limits of the policy.

10.2 The RCA policy does NOT cover damage to the rented Motorcycle itself. The Lessee is therefore liable for all damage to the Motorcycle.

10.3 Insurance coverage is automatically void and the Lessee becomes fully liable without a deductible limit in any of the following circumstances:

  • The Motorcycle is ridden under the influence of alcohol, drugs, narcotics, or impairing medication.
  • The Motorcycle is ridden by any person not named in this Agreement.
  • The Lessee leaves the scene of an accident without fulfilling their legal obligations.
  • Damage is caused intentionally or as a result of gross negligence.
  • The Lessee fails to report an accident to Outlandica within 2 hours of its occurrence.
  • The Motorcycle is used for a purpose prohibited under Section 8.
  • The Lessee fails to comply with any obligation in Section 7 and such failure materially contributes to the loss or damage.
  • The Motorcycle is ridden in an unsafe manner and without abiding by road laws.

10.4 Outlandica strongly recommends that all Lessees take out adequate personal travel, health, and accident insurance before the Rental Period. Outlandica accepts no liability for personal injury, illness, or death, nor for loss of or damage to the Lessee's personal belongings.

11. Lessee Liability for Damage

11.1 From the moment of pickup until the Motorcycle is returned and a joint return inspection is signed by both parties, the Lessee is liable for all damage to the Motorcycle, including accidental damage, damage caused by falls, and damage resulting from improper use.

11.2 The Lessee acknowledges that they are liable for any damage to or theft of the Motorcycle and rented accessories, up to and including the full replacement value of the Motorcycle and all rented accessories. The Security Deposit does not limit the Lessee's maximum exposure, in the cases specifically listed in Section 11.4.

11.3 Standard Damage Deductible: in the event of accidental damage (including damage sustained during permitted Off-Road Riding within the conditions of Section 9), the Lessee's liability is capped at the Security Deposit amount (the Damage Deductible), provided the Lessee has complied with all obligations in this Agreement.

11.4 Full liability without deductible cap applies in the circumstances listed in Section 10.3, and additionally in the following situations:

  • Damage caused by use of the Motorcycle on prohibited terrain (Sections 8 and 9.3).
  • Damage caused by stunts, burnouts, wheelies, or deliberate misuse.
  • Damage caused by a person not named in this Agreement.
  • Loss or theft resulting from the Lessee's failure to adequately secure the Motorcycle.

In these cases the Lessee is liable for the full replacement value of the Motorcycle and all rented accessories, without any cap.

11.5 Damage to or loss of rented accessories (helmets, riding gear, luggage, GPS device) is charged at full replacement or repair cost, irrespective of the Damage Deductible.

11.6 If the Motorcycle is rendered unrideable or requires repair due to damage caused by the Lessee, the Lessee is not entitled to a replacement motorcycle and no refund is made for unused rental days. In addition, the Lessee may be charged for loss of rental income for each day the Motorcycle is unavailable for rental as a direct result of the damage, calculated at the applicable daily rental rate for that motorcycle.

11.7 The cost and estimation of all damage is determined by Outlandica at Outlandica's sole discretion. Outlandica commits to carrying out all assessments fairly and in good faith. Outlandica may obtain a supporting assessment from a qualified mechanic or assessor where appropriate. The Lessee is liable for the reasonable cost of the damage assessment in addition to repair costs. Outlandica reserves the right to assess possible damages up to 10 business days after the return of the motorcycle.

11.8 Outlandica reserves the right to charge for damage discovered upon return even if the Lessee did not report it during the Rental Period.

12. Accident and Incident Procedure

In the event of any accident, theft, damage, or incident involving the Motorcycle during the Rental Period, the Lessee must:

  • Stop the Motorcycle immediately and ensure personal safety and the safety of others.
  • Call the emergency services (112) immediately if there are any injuries.
  • Notify Outlandica by phone as soon as possible and in any event within 2 hours of the incident, providing an accurate account of events and the Motorcycle's precise location. In case of incapacity or lack of signal, the lessee should notify Outlandica as soon as he is able to do so.
  • If the incident involves a third party or results in any injury, call the Romanian Police (Politia Romana) and remain at the scene until they attend. Do NOT leave the scene of an accident.
  • Collect and preserve all available evidence: photographs of the scene, damage, and other relevant details; names, addresses, and telephone numbers of all parties involved and any witnesses; registration numbers of all vehicles involved.
  • Complete an Accident Statement ("Constatare Amiabila de Accident") if applicable and available. Contact Outlandica first before signing any such agreement.
  • NOT arrange or authorise any repair to the Motorcycle without Outlandica's prior written consent.
  • Submit a written incident report to Outlandica within 24 hours.

In the event of theft or loss of the Motorcycle, the Lessee must report it to the Romanian Police immediately and provide Outlandica with a copy of the police report within 24 hours.

13. Mechanical Failure and Roadside Assistance

13.1 In the event of a mechanical failure through no fault of the Lessee, the Lessee must contact Outlandica immediately, providing precise location details and a description of the problem. No repairs may be undertaken without Outlandica's prior written authorisation.

13.2 Outlandica will arrange repair or a replacement motorcycle, subject to availability, as soon as reasonably practicable. If a replacement cannot be provided, Outlandica will refund the pro-rated rental fee for the period during which the Motorcycle was immobilised through no fault of the Lessee.

13.3 Where a repair at a local workshop is authorised by Outlandica, Outlandica will cover the reasonable cost of repair for mechanical faults not attributable to the Lessee. The Lessee must obtain and retain all receipts.

13.4 If a breakdown or failure is caused by the Lessee's negligent use, misuse, or failure to carry out the daily checks required under Section 6.3, all resulting costs (repair, towing, accommodation) are borne by the Lessee. No replacement motorcycle or refund is owed in such cases.

14. Traffic Violations and Fines

14.1 The Lessee is solely responsible for all traffic violations, speeding offences, parking infringements, and any other regulatory contraventions committed with the Motorcycle during the Rental Period. All fines must be paid directly to the relevant authority within the period stipulated.

14.2 For each penalty notice received by Outlandica on behalf of the Lessee (including speed camera fines received by post after the Rental Period ends), Outlandica will charge an administration fee of EUR 25 in addition to passing through the full amount of the fine to the Lessee.

14.3 By signing this Agreement, the Lessee authorises Outlandica to disclose the Lessee's personal data (name, address, and licence details) to police, judicial, or administrative authorities for the purpose of attributing and processing traffic fines.

15. Personal Protective Equipment

15.1 Use of a properly fitted, ECE 22.06-approved (or equivalent) motorcycle helmet is mandatory throughout the Rental Period. The Lessee must not ride the Motorcycle without a helmet.

15.2 Outlandica strongly recommends: a CE-approved riding jacket with back protector; riding gloves; CE-approved riding trousers or overtrousers; and ankle-covering motorcycle boots.

15.3 Helmets and selected riding gear are available for rent from Outlandica (see Section A4). The Lessee may use their own equipment, provided it meets current safety standards.

15.4 Outlandica is not liable for any injury, death, or damage resulting from the Lessee's choice to ride without adequate protective equipment, or with equipment that does not meet applicable standards.

16. GPS and Vehicle Tracking

16.1 The Motorcycle may be equipped with a GPS tracking device. The Lessee acknowledges this and consents to the vehicle's location being monitored by Outlandica during the Rental Period.

16.2 The Lessee must not tamper with, disable, or remove the GPS device. Tampering constitutes a serious breach of this Agreement and will render the Lessee fully liable for all resulting consequences.

17. Force Majeure

17.1 Neither party shall be liable for any failure or delay in performing its obligations under this Agreement where such failure or delay results from a Force Majeure event beyond that party's reasonable control.

17.2 The party affected must notify the other party as soon as reasonably practicable. The affected obligations are suspended for the duration of the Force Majeure event. If the event continues for more than 14 days, either party may terminate this Agreement without penalty, with a proportional refund for unused prepaid rental days.

18. Data Protection and Privacy (GDPR)

18.1 Outlandica SRL processes the Lessee's personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and applicable Romanian data protection legislation.

18.2 The personal data collected in this Agreement (name, date of birth, address, identity and licence details, payment information, and GPS location data) is processed for the following purposes: (a) performance of this Agreement; (b) compliance with legal obligations, including disclosure of driver data to traffic authorities; (c) pursuit of Outlandica's legitimate interests in damage recovery and fraud prevention.

18.3 Personal data will not be sold. It will not be disclosed to third parties except where required by law, where necessary for insurance or legal proceedings, or where the Lessee has given explicit consent. Data is retained for a minimum of 3 (three) years following the end of the Rental Period, or longer where required by law.

18.4 The Lessee has the right to: access their personal data; request rectification of inaccurate data; request erasure where legally permitted; object to processing; and request data portability. Requests should be directed to Outlandica's registered email address: [email protected].

18.5 The Lessee may lodge a complaint with the Romanian data protection supervisory authority ("Autoritatea Nationala de Supraveghere a Prelucrarii Datelor cu Caracter Personal", www.dataprotection.ro).

19. Limitation of Outlandica's Liability

19.1 Outlandica's aggregate liability to the Lessee under or in connection with this Agreement shall not exceed the total rental fee paid by the Lessee for the Rental Period.

19.2 Outlandica is not liable for: (a) personal injury, illness, or death suffered by the Lessee or any third party, except where directly caused by Outlandica's own gross negligence or wilful misconduct; (b) loss, theft, or damage to the Lessee's personal belongings; (c) loss of earnings, business opportunity, or any other consequential or indirect loss; (d) the condition of roads or off-road terrain used by the Lessee; or (e) delays, route changes, or disruptions caused by weather, road conditions, or Force Majeure.

19.3 Nothing in this Agreement limits or excludes liability where such exclusion is prohibited by Romanian mandatory law or consumer protection legislation.

20. Governing Law and Jurisdiction

20.1 This Agreement is governed by the laws of Romania, including the Romanian Civil Code, the Road Traffic Ordinance and all applicable consumer and data protection legislation.

20.2 In the event of a dispute, the parties agree to first seek resolution by good-faith negotiation. If no resolution is reached within 30 days of written notice of the dispute, it shall be referred to the competent courts of the judicial district of Cluj Napoca, Romania, to the exclusion of any other jurisdiction.

20.3 The Lessee may also pursue a complaint through the National Authority for Consumer Protection ("Autoritatea Nationala pentru Protectia Consumatorilor") or the EU Online Dispute Resolution platform.

21. Miscellaneous Provisions

21.1 Entire Agreement: this Agreement (Part A — Rental Agreement and Part B — Terms and Conditions) constitutes the entire agreement between the parties with respect to the rental of the Motorcycle and supersedes all prior representations, understandings, or agreements.

21.2 Amendments: no amendment to this Agreement is valid unless made in writing and signed by authorised representatives of both parties. Verbal representations by Outlandica's staff are not binding.

21.3 Severability: if any provision of this Agreement is held invalid or unenforceable by a competent court, the remaining provisions continue in full force and effect.

21.4 Waiver: failure by either party to enforce any provision does not constitute a waiver of the right to enforce that provision in the future.

21.5 Language: this Agreement is written in English. In the event of any inconsistency between an English version and a Romanian translation, the English version prevails for interpretation purposes, except where Romanian mandatory law requires otherwise.
